- Safety catch on gear shift was broken and had to be in gear to start.
- Emergency/parking brake was inoperable.
Worker was starting backhoe when it lurched forward and ran over him. He died from his injuries.
Construction Accident Indiana Prevention
- Employers and contractors must train workers to recognize and avoid unsafe conditions associated with their work (29 CFR 1926.21(b)(2)).
- A competent person must inspect and identify all equipment that does not meet OSHA requirements by tagging the equipment or locking the controls to the equipment rendering it inoperable or by physically removing it from the jobsite (29 CFR 1926.20(b)(3)).
