Construction Fatalities are possible when a Worker Falls from Height out of an Aerial Lift

Posted on August 18, 2011 by Ronald Todd

Falls from Height Kill Lift Operators

Worker was using an aerial lift with an extendable boom work platform. Worker was moving the lift when he was thrown from the basket. The boom was fully extended. The lift ran over some bricks causing the boom to flex or spring. The worker fell out. He suffered severe traumatic brain injury and chest injuries. He died from his injuries.

Prevention of Construction Fatalities from Aerial Lifts

  1. Contractors must have a competent person who conducts frequent regular inspections of the worksite, materials and equipment (29 CFR 1926.20(b)(1)).
  2. Contractors must train workers to properly operate equipment and machinery prior to its use (29 CFR 1926.20(b)(4)).
  3. Contractors must instruct workers in the recognition and avoidance of construction site hazards and the regulations applicable to his work environment (29 CFR 1926.21(b)(2)).
  4. Contractors must prohibit unauthorized persons from operating aerial lifts (29 CFR 1926.556(b)(2)(ii)).
  5. Contractors must require the wearing of harnesses and lanyards when in aerial lifts (29 CFR 1926.556(b)(2)(v)).

Workers Compensation is not your only Option after a Construction Site Injury

You do not have to settle for workers compensation after your construction site injury. Because several individuals or organizations work at a construction site, many parties may be liable for injuries. Liable parties include the construction site owner, contractors, construction managers and engineering professionals. Manufacturers of construction machinery also may be liable for accidents.
Both general and subcontractors have legal obligations to provide a construction site that is reasonably safe and must warn employees of any hazards on the site or related to the type of work.
A general contractor is responsible for job safety on the entire site and must comply with all OSHA regulations. Although the general contractor ultimately is responsible for construction safety, any subcontractor brought onto the site also must ensure job safety and must comply with OSHA regulations.
