Underage drinking and driving is a crime in Indiana. The lower thresholds reflect Indiana's intolerance of underage drinking and driving. In Indiana, the blood alcohol content (BAC) for an adult is .08% to be found per se guilty of OWI. For a person under the age of 21, the threshold is .02% BAC.

Underage drinkers are subject to the same penalties as adults, with the exception that their license suspension is likely to be for one year, rather than the 180 day suspension given to adults.

In addition, adults who are charged with OWI face much more stringent penalties if a passenger under the age of 18 is in the car.
