Consequences of a Drunk Driving Conviction

If you are convicted of OWI, you may be subjected to the following consequences:

First Time OWI Offenders:

Jail time - first time offenders can be jailed for up to one year, although in many instances we are able to negotiate deferment of the charges upon condition of alcohol evaluation and treatment program. If you successfully complete the program, we may be successful in having your charges dismissed. You are only eligible to participate in the program one time.

  • Driver's license suspension - first time offenders may receive up to 180 days for a conviction (one year for failure to submit to a chemical or breathalyzer test). In many cases we can get this reduced upon the conclusion of your case. In some cases, we can also assist you in obtaining a hardship license to allow you to use your vehicle to go to and from work or perform other necessary tasks.

Fines - first time offenders may receive fines up to $5000.00. We work hard to minimize your fines, although our primary concern is keeping you out of jail and minimizing your driver's license suspension.

  • Underage drinking and driving - first time offenders will have the same consequences, with the exception that license suspensions will most likely be for one year. Also, the threshold is lower--.02% blood alcohol rather than .08% for an adult.
  • Commercial drivers - first time offenders will have the same consequences. However, for CDL holders, the legal threshold is also lower -- .04% blood alcohol rather than the .08% for other drivers.

Insurance rates - first time offenders will likely see their insurance rates go up dramatically, or may even have their insurance companies cancel their policy.

Habitual Offenders:

A second conviction results in mandatory jail time.

A third or subsequent conviction results in a felony conviction, which cannot be suspended and requires a minimum of six months jail time. In addition, Indiana's Habitual Traffic Violator law allows for license suspensions of five years, ten years, or a lifetime suspension.

Felony DUI Charges:

If an accident involving serious injury or death results from drinking and driving, or if this is your third OWI offense, you can be charged with a felony DUI, which may have much stiffer penalties.
