If you are stopped for any reason, and requested to perform a field sobriety test or take a breathalyzer test to determine if you are operating a vehicle while intoxicated on drugs or alcohol (OWI), you need to know your rights and the actions you should or should not take. Q. Do I need to submit to a chemical (breathalyzer, blood, or urine) test?
A. No, BUT failing to submit to a breathalyzer or other chemical test will result in automatically losing your driving privileges for one year, i.e., you will receive a one year license suspension for failing to submit to chemical test. In addition, you have no say in the type of chemical test requested, nor are you entitled to legal representation to assist you in your decision of whether to submit to chemical test.
Q. What should I do if I am charged with OWI or other alcohol related offense?
A. Do not answer any questions. The police are not your friends; they are trying to gather more evidence to assist them in obtaining a conviction. Once you have been charged, request to call an attorney. You may call us at 317-514-7271.
Q. Are the BAC levels for OWI the same for everyone?
A. No. For most drivers, the BAC level is .08, for commercial driver's license holders (CDL), the BAC level is .04, and for underage people (under 21), the BAC is .02.
Q. Can I go to jail for OWI?
A. Yes. A judge can order from 60 days up to one year in jail for an OWI conviction. Please see our OWI-DUI-DWI Consequences page for additional information.
Q. Do I need an attorney?
