A hardship license is a special restricted license issued by the court to allow an accused the ability to go to and from work while a case is pending. A hardship license requires a showing of undue hardship upon an accused's family or dependants, and may be granted if a person has no prior arrests or convictions of DWI or other alcohol-related drinking and driving offense.

Also, if a person refused a breathalyzer or other chemical test (blood or urine), or holds a commercial driver's license (CDL), then that person cannot obtain a hardship license.

If an Indiana hardship license is issued, it will not be valid until after a driver has served at least 30 days of the 180-day mandatory suspension.

Under Indiana law, a hardship license must be issued by the court if the applicant is enrolled in a qualified rehabilitation class at the time the application is made. Otherwise, the judge has total discretion to grant or deny the application for a hardship license. In most instances, the judge will require enrollment in a qualified rehabilitation class prior to approving a hardship license application.
